Introduction

The access to and consultation of the pages of the website www.geomagworld.com (hereinafter, the “Website”) is subject to the acceptance of the conditions specified below (hereinafter the “Conditions of Use“) by the User.
The Website is owned by Geomagworld SA (hereinafter “Geomag” or the “Company”) and has the purpose of providing information on the activities undertaken, the services provided and the new products sold by Geomag.
The access to and use of the Website by the User is subject to the acceptance of the Conditions of Use.
If the User does not intend to accept the Conditions of Use, he or she should abstain from navigating the Website and leave it.
Geomag reserves the right to update or modify these Conditions of Use at any time, without having to provide notice, and the User navigating the Website is responsible for reading the new Conditions of Use, which shall be considered binding from the moment of publication on-line.
Users are therefore invited to periodically check these Conditions of Use and the other sections of the Website including the privacy policy on the processing of personal data (“Privacy Policy”) and the information notice on the use of cookies (“Cookie Policy”).

Intellectual and Industrial property rights

All contents published or present on the Website, including but not limited to texts, images, photos, audio and video tracks, designs, graphics, logos, symbols, names, product and company names, and all the software contained in it and all other files, and the related selection and use ( the “Contents“), are protected by Copyright Law (Italian Law no. 633 of 22/4/1941) and by the other Italian and international laws on the protection of the intellectual property, industrial property, trade marks and designs owned by Geomag and its related affiliates, users or licence holders. All rights are reserved. No Contents of the Website may be amended, copied, distributed, inserted, reproduced, re-published, downloaded, viewed, published, broadcast or sold in any form and using any means whatsoever, wholly or partly, without the prior written authorisation of Geomag, except in the case in which this applies to any Contents legitimately published by the User on the Website. Moreover, no digital contents of any kind may be copied into other programmes without the prior written authorisation of Geomag. Where authorised to use the Website, the User is granted a limited licence to view and use the Website and the Contents and to download or print a copy of any portion of the legitimately accessible Contents, only for personal and not for commercial use, on condition that he or she maintains all the notes on copyright and other property rights unaltered. With the exception of his or her own Contents, the User may not upload or re-publish the Contents of the Website on other Internet, Intranet or Extranet websites, nor incorporate the information in other databases or repertories. Any other use of the Contents of the Website are strictly forbidden. This licence is subject to these Conditions of Use and does not include the use of data mining, robots or similar methods to collect or extract data. Any use of the Website or the related Contents other than that explicitly authorised herein is strictly forbidden without the prior written authorisation of Geomag, and will lead to the withdrawal of the granted licence. Unauthorised use may also breach the applicable laws, including but not limited to the laws on copyright and trade marks and the applicable regulations and statutes on communications. Unless otherwise expressly specified in this document, no contents of these Conditions of Use shall be interpreted as granting a licence over the intellectual property rights. These rights on the Contents are held by Geomag or are legitimately available to it, and none of these may be interpreted as granted in licence to the User or third parties.

Trade marks

“GEOMAG” and other registered trade marks, logos, fonts, page headings, button icons, scripts, service names and other marks (jointly referred to as the “Marks”) displayed on the Website are subject to trade marks rights and other rights of Geomag or its related affiliates. Geomag’s Marks may not be used, including in other marks and/or domain names, in relation to products or services that may in any way cause confusion, and may not be copied, imitated or used, wholly or partly, without the prior written authorisation of Geomagworld. The use/abuse of the Trade Marks displayed on the Website or in any other Contents of the Website, without prejudice to the terms of these Conditions of Use, is strictly forbidden.

Use of the website and its contents
All information and materials on the Website are presented exclusively to provide general and promotional information on Geomag’s products. This information and materials do not constitute an offer for the products of Geomag, official retailers or third parties, nor do their constitute warnings or other instructions on the use of Geomag products.
The Website may contain information on the global products of Geomag which may not be available in all countries. The reference to a Geomag product or service shall not imply that such product or service is or will be available in the Country in which the User consults the Website.
The Website and the Contents may be used only for personal use and information. The full or partial reproduction of the Contents is forbidden without the express authorisation of Geomag. The use of the Website and its Contents for commercial and/or profit purposes is not permitted under any circumstances whatsoever.
The Website may contain hypertext links to websites other than the Website owned by Geomag or third parties: Geomag shall under no circumstances be deemed liable for the contents of these websites accessed via the links and/or for any damage suffered due to the use of said websites beyond the control of the Company.
Any information concerning personal data sent to the Website by users by completing the forms on the Website shall be processed in full compliance with the applicable laws and the privacy policy on the processing of personal data provided by Geomag (Privacy Policy).

Improper use of the Website and cyber-attacks

Users navigating the Website may not and must not use the website improperly. The User who knowingly introduces viruses, malware, trojan horses, ransomware, keyloggers, spy programmes, software containing advertising, or other elements, programmes or codes which may compromise the operation of the software or the IT equipment, leading to or attempting to lead to unauthorised access to the servers hosting the Geomag Website, or any other server, computer or database connected to our Website; or seeking to interrupt the Website service by isolated IT attacks or attacks launched at the same time from different sources (e.g.: SQL-injection, Cross-Site Scripting, .DDos attacks…) may be an offence pursuant to Articles 615-(3) and 615-(5) of the Italian Criminal Code. Geomag shall report such breaches to the competent Legal Authorities and shall work with them, providing all useful navigation data to trace the identity of the hacker. Any Users found liable of such breaches shall immediately lose the right to use the Website.

Communications

All communications and materials sent to the Website by e-mail or other means, including data, questions, comments, suggestions, etc., shall be treated as non-reserved and non-exclusive. Any Contents sent or posted may be used by Geomag or its affiliates for purposes which may include, but are not limited to, reproduction, dissemination, transmission, publication, disclosure and sending. The Company is also free to use ideas, concepts, know-how or technical contents in any communication sent to the Website for any purpose, including but not limited to the development, production and marketing of products using this information.

Exclusion of liability

Despite doing everything possible to ensure that the Website contains precise and up-to-date information, Geomag does not issue any guarantees or declarations of any kind in relation to the Contents of the Website, which are provided “as is”. In particular, Geomag neither guarantees nor declares that the use of the Contents of the Website by the User will not breach the rights of third parties who do not belong to or are not affiliated to Geomag.
Geomag holds no liability, and shall not be deemed liable, for any damage or virus infections to the User’s computer or other devices following the access to, use or exploration of the Website, or the downloading of any materials, data, texts, images, videos or audio files from it.
Geomag reserves the right to interrupt or suspend any functions of the Website. Geomag declines all liability or obligation for any obligation for any interruption or suspension of the Website functions, whether this is due to actions or omissions by Geomag, the companies affiliated to Geomag, or third parties.
The materials on the Website, including the information, may contain technical or typographic errors. Geomag reserves the right to amend, correct and/or improve the above-mentioned materials (including the information), and the products and programmes described in this information, at any time and without notice.
Connections to and from other websites
Geomag has no control and offers no guarantee over the contents of the websites to which the Website is connected, nor has it checked them, the User therefore acknowledges that the Company is not liable for the contents of pages external to the Website or any other website it may be linked to. The User is exclusively liable for access to external pages of linked third party websites.
The User connects to the Website, external pages or other websites at his or her own risk. Using such linked, the User understands that the legal notices and privacy rules applied to linked websites may be different to those of Geomag. The User may create a connection to the Website, provided such connection is done on the home page, without reproducing it, and in compliance with the following conditions.
Website framing in other websites or elements of websites belonging to parties other than Geomag is not permitted. Equally, in-line linking or any other method for incorporating sections of the Website in websites belonging to parties other than Geomag is also forbidden.

Access to the service

Despite making all efforts to guarantee the regular availability of the Website 24 hours a day, seven days a week, Geomag may not be held liable if, for any reason whatsoever, the Website is unavailable at a given time or for a given period.
Access to the Website may be temporarily suspended without notice in the event of system failures, maintenance or repairs, or due to causes beyond the control of Geomag.

Limitation of liability

To the fullest extent permitted by applicable law, with the exception of damage caused intentionally or by gross negligence, Geomag, and any other company affiliated to Geomag, including their officers, directors, employees, shareholders or agents, decline all liability and obligation for any loss or damage of any amount and nature caused to the User or third parties (including, but not limited to, direct, indirect or consequential damages, loss of revenues, profits, goodwill or data) in connection with the Website or with the use, impossibility to use or consequences deriving from the use of the Website, of any linked websites or material contained therein, including, but not limited to, losses or damage caused by virus infections to the User’s computer, software, data or other devices following access to, use or exploration of the Website, or after downloading materials from the Website or linked websites.

Miscellaneous

Any omission by Geomag to exercise or apply any right or clause of these Conditions of Use shall not constitute a waiver of such right or clause. The section titles in the Conditions of Use are provided exclusively for practical reasons and have no legal or contractual effect.
The invalidity or inapplicability of any clause of these Conditions of Use shall not modify or compromise the validity, legality and applicability of the remaining clauses hereto in any way.

Applicable law and jurisdiction

The Conditions of Use shall be interpreted and governed according to Swiss Law, excluding the United Nations Convention on Contracts for the International Sale of Goods. As far as is permitted by Law, the competent courts in the place in which Geomag has its registered office, currently in Biel/Switzerland, shall have exclusive jurisdiction over any disputes arising from these Conditions of Use or from the use of the Website by the User, in conformity with Geomag’s right to bring action against a user in its place of residence.

Other provisions

These Conditions of Use, along with the Privacy Policy and the Cookie Policy, govern all the relations between Geomag and the User of the Website in relation to the use of the Website. If any of these provisions is annulled or declared null or in any case inapplicable, the remaining provisions shall remain fully valid and effective.
